Latinos who worked in California and Texas nursing homes owned by Skilled Healthcare Group Inc. who claimed they were punished for speaking Spanish while at work will receive up to $450,000, free English classes and other compensation under a consent decree from a class-action lawsuit filed by the U.S. Equal Employment Opportunity Commission in Los Angeles, according to the Los Angeles Times.
Two senators have reintroduced legislation aimed at improving the quality of care in nursing homes. The Nursing Home Transparency and Improvement Act, reintroduced by Senators Chuck Grassley (R-IA) and Herb Kohl (D-WI), would give consumers more information about the quality of care at nursing homes, provide the government with better tools to enforce high quality standards, and encourage nursing homes to improve on the care they provide, according to Trading Markets.

Brianna Marie Broitzman and Ashton Michelle Larson, the two nursing home aides facing misdemeanor charges in the Albert Lea “abuse-for-thrills” case that has garnered national media attention in recent months, will face a judge for the first time this week, according to the Minneapolis-St. Paul, Minnesota Star Tribune/Associated Press. The women are not expected to enter pleas until a pretrial hearing scheduled for March 23.
The larceny and conspiracy trial of a man whose family once owned one of the largest nursing homes in Dedham, Massachusetts, began this week, according to the Patriot Ledger. Gregory Logan served as the administrator of Logan Nursing & Rehabilitation Center in Braintree, one of the family’s five nursing homes. Logan and his uncles Joel K. Logan and Todd Logan were all accused of raiding patient accounts for personal use between January 2001 to June 2003.
Joe Bilgen said the sexual abuse his father endured at the hands of Ohio nursing home night shift nurse John Riems was akin to child abuse because Riems victims had similar states of mind. The fiancé of another victim told the Associated Press that Riems was an, “ancient evil spirit of torment.”
Tennessee nursing homes are lobbying the legislature to put a cap on the amount of damages that plaintiffs can collect in court, according to a report in Nashville, Tennessee’s The City Paper. Sixteen states, including Tennessee, do not put monetary limit for damages such as pain and suffering, which has resulted in millions of dollars in damages awarded to victims for nursing homes‘ violations of patient care. The nursing home industry says without damage limits, nursing homes in those states become a target for out-of-state trial lawyers.
Sixty-seven-year-old Melvin Raybon laid helpless in his bed at Tucker Nursing Center in Tucker, Ga., while a bedsore grew on his left buttocks and became infected to the bone, according to the Atlanta Journal Constitution. Staff at the nursing home where he lived should have turned him every two hours to prevent the massive bedsore. However employees said there simply wasn’t enough staff to meet that need. Instead, the attorney representing Raybon’s daughter said he was turned about every four hours.
Nearly 8,500 Florida Medicaid recipients have filed a federal lawsuit seeking class action status for forcing them to live in nursing homes instead of where they choose, according to the Associated Press/Miami Herald. The lawsuit names the Florida Agency for Health Care Administration, the Florida Department of Elder Affairs and Florida Gov. Charlie Crist’s office.
Joanne Kessler believed she was doing the right thing when in 2006 she moved her mother, Luveda Fern Kessler, from another assisted living facility to Villa Valencia Health Care Center in Orange County, Calif., to be closer to her. The elder Kessler had had both hip- and knee-replacement surgeries and used a walker for mobility. She needed assistance getting out of bed and to the bathroom, a nurse noted.
